Baldivis Community Services donate food that has been received from various local businesses and various Charities in WA, as a benevolent purpose and in good faith.

The food is donated with the intention that the receiver of the food does not have to pay for the food, and the food was safe to consume at the time of donation.

The food is safe to eat when it leaves the possession or control of Baldivis Community Support services, and the donor will give the consumer any information it needs to ensure the ongoing safety of the food if applicable.

Inspection:

Recipient Acknowledges inspection of each donation of goods, and satisfaction with their condition.

Indemnity:

Baldivis Community Services, hereby expressly disclaims all warranties, written or oral, statutory, express or implied, including any warranty of wholesomeness, merchantability, condition, quality, fitness of use, or suitability of the goods in any respect whatsoever, including any warranty regarding the absence of any defects therein, whether latent or patent; it being understood and agreed that the goods are being donated in their current condition as of the date hereof. In connection with BCS donation of the goods, Donor shall indemnify the consumer against any claims, liabilities, costs incurred by the consumer arising out of, or in consequence of any act, neglect, or default of food for charities, its agents, or employees. 

This agreement and the terms and conditions set forth herein constitute the complete and final agreement between BCS and the recipient relating to donation of the goods and supersedes all prior agreements, whether written or oral, relating to the subject matter hereof. No agreement in anyway modifying these terms and conditions will be binding upon the BCS or Recipient.

This agreement shall be governed by and constituted in accordance with the laws of Western Australia (including without limitation of the good Samaritan food donation act Law of Australia).

Recipient shall not use BCS name, or any trademark or reference related to such in connection with the donation, use or disposal of the goods, without express approval.

In witness whereof the undersigned have each read the foregoing agreement and agrees with it.
